In January 2021 Rotherwick Parish Council applied to the Charities Commission to enter Rotherwick Playing Fields Trust CIO onto the Register of Charities. The application was approved on the 8th March 2021 and issued with the
Registered Charity Number 1193733.
History
Rotherwick Parish Council entered into a Deed of Dedication with the National Playing Fields Trust (latterly known as Fields in Trust) on 1st May 2008. In entering into the Deed of Dedication the RPC, as at that date irrevocably (and permanently) parted with its ownership of the playing fields. Since 1st of May 2008, RPC became merely the nominal legal owner of the land, the beneficial ownership (i.e. the commercial value of the land, such as it may have been given in the 1952 covenant of use as a playground) has since that date been held by RPC as trustee for 'the inhabitants of Rotherwick".
Why Register with Charities Commission?
The Deed of Dedication entered into on 1st of May 2008 required Rotherwick Parish Council to register the charitable trust with the Charities Commission.
The other reason for registering with the Charities Commission was to more readily access external funding only available to registered charities.
Why a CIO?
An important reason why charities may choose to incorporate (and so automatically register) is so that any land (or indeed other property) can be held by the charity as a separate legal person (as this is what a CIO is) rather than in the name of the individual trustees. Other good reason why charities should incorporate, in particular because it enables individual trustees to manage their personal risk more appropriately.
